When You Can Bring Forth a Wrongful Death Claim

In order for a claim to be successful, the personal representative of the deceased (plaintiff in a wrongful death action) will need to prove that the defendant owed the deceased a duty of care, that the duty of care was breached, and that the breach of the duty of care was the proximate cause of death. The plaintiff will also need to establish the extent of loss suffered by themself/surviving family members, including:
- Medical expenses prior to death;
- Value of the decedent’s loss of earning capacity and wages;
- Funeral and burial expenses;
- Loss of companionship and guidance; and
- Grief, sorrow, and mental suffering.
