Woodstock Wrongful Death Lawyer

An accident that takes the life a loved one can occur in the blink of an eye and without warning, and in a flash, your whole life may be completely changed. At the firm of Brassfield & Krueger, Ltd., our Woodstock wrongful death lawyers appreciate how tragic fatal accidents are, and what your family is going through.

We understand that there is nothing that we, or anyone else, can do to change what has happened and bring your family member back, but we do hope that we can provide you with aggressive legal representation as you seek compensation for the monetary value of your losses.

Types of Accidents that Lead to Wrongful Death Claims

If you are the personal representative of the deceased, you may be able to bring forth a wrongful death claim following any accident type that results in death that was caused by the wrongful act, neglect, or default of another party. For example, the following accident types may warrant wrongful death actions–

When You Can Bring Forth a Wrongful Death Claim

A wrongful death claim, as stated above, can be brought when the death of the decedent would not have occurred but for the wrongful act, neglect, or default of another party, and when the decedent would have maintained the right to bring forth a personal injury action against the defendant had the accident not resulted in death. In order for a claim to be successful, the personal representative of the deceased (plaintiff in a wrongful death action) will need to prove that the defendant owed the deceased a duty of care, that the duty of care was breached, and that the breach of the duty of care was the proximate cause of death. The plaintiff will also need to establish the extent of loss suffered by themself/surviving family members, including:

  • Medical expenses prior to death;
  • Value of the decedent’s loss of earning capacity and wages;
  • Funeral and burial expenses;
  • Loss of companionship and guidance; and
  • Grief, sorrow, and mental suffering.
